Donor done

3 December 2007 by Tim 2 Comments

“A sperm donor who helped a lesbian couple have two children is now being forced to pay thousands of pounds for their upbringing, he said.” Torygraph

I must admit I don’t understand this at all. While I can see that there may be no blanket protection for donors unless they ‘work’ through a licensed clinic, it does seem to me in this case that the couple’s statements provided him with an indemnity against future claims and so he should be entitled to recover any payments he makes from both of them.

Very biased piece of reporting which insinuates that it’s the couples fault. The CSA have obviously been involved because one of them has applied for Income Support, unfortunately whether you a gay or straight woman you are legally obliged to hand over the father’s name if you apply for IS.
Yet more stupid, crazy laws messing with people’s lives.

Quite agree on the tone of the piece. One of those “wicked lesbians at it again doing down us honest hard working heterosexuals” pieces. I think the guy was dumb not to see this one coming, but nevertheless, I still think he is entitled to enforce the indemnity the mother’s partner gave. A verbal contract is still a contract. He acted to his detriment on the strength of her assurances, so she is liable.
The mother, obviously, can only deal with the situation she is actually in, not with the one she had hoped to be in. IYSWIM.
